By accessing or using the Islandus.com website for information, obtaining a quote or placing an online order, you agree to be bound by these terms and conditions of use as amended from time to time.
Quote
You may submit information about your desired vehicle´s specification for an online quote. Quote is for information purposes only and is not an offer to sell you a vehicle. If you are happy with the price contained in the quotation, you should contact our sales department to negotiate a SpotPrice order.
SpotPrice Order
When you have placed your SpotPrice order our purchase brokers will research the market, manufacturer and dealer databases in order to find a vehicle that matches your requirement within the Spotprice limit you have specified. If we find a match for your desired vehicle, we bill you a EUR 250 service fee or similar amount in your local currency and proceed to Inspection if a used vehicle or directly to BuyersOrder if a factory new vehicle.
Inspection
If the vehicle is used we will ask the seller to hold the vehicle until we have had the opportunity to send our inspector to his location. We conduct research into the full history of the vehicle and send an inspector out to check, inspect and test drive the vehicle. The cost of inspection is included in our SpotPrice service fee. At your request we will repeat the process free of charge for another vehicle if the inspection reveals faults that were not described by seller in his advertisement. Inspection is not carried out on new vehicles from manufacturer.
Vehicle inspections are carried out by reputable and specialized vehicle inspection services or professional service facilities. We send you a copy of the inspection report. Should serious faults that were not described by the seller beyond normal wear and tear and minor surface scratches be revealed through the inspection, we will contact you for approval prior to completing purchase and payment for the vehicle.
Inspection report will be an accurate portrayal of the inspector's evaluation of the vehicle similar to what you would see and hear if you were to inspect the car yourself if you had similar professional experience. However, weather, light conditions and cleanliness of the vehicle both inside and out at the time of inspection can make things as repainting and body work difficult to detect. In addition to physical inspection, we rely on vehicle history data to detect any accident history and will provide you this information upon request. Many aspects of vehicle inspections are subjective. Our inspectors are always a third party whose sole alliance is to you the purchaser. Their task is to report any and all faults they can find with the vehicle and provide their opinion. Their opinion may differ from your own conclusion if you performed the inspection yourself. We cannot be responsible for any such differences.
Buyers Order and Price
Upon confirmation of your SpotPrice Order we will send you our Buyers Order with confirmation of the vehicle VIN (Manufacturers Number), final price, shipping destination, sales terms and conditions. We ship vehicles to most destinations around the world, sometimes as Duty Free (CIF) and sometimes with the inclusion of duty and VAT in the destination country. When you have returned you signed Buyers Order to us by Fax and when your deposit payment has been received by our bank, the Buyers Order becomes a valid Purchase Agreement.
We will present to you all information we have about the condition of the vehicle including the inspection report if a used vehicle. The vehicle is sold as is in its current condition and subject to the terms and conditions written in the Buyers Order and our general terms and conditions published herein on the islandus.com website.
Homologation and Registration
In many countries we can offer homologation modification and local registration for your vehicle. If we agree to provide these services it will be specified in your Buyers Order.
Deposit Payment
20% deposit is required to confirm a Buyers Order. Payment terms of the balance vary depending on vehicle type and final destination. Generally if we have agreed to supply you the vehicle customs cleared with Duty and VAT in your home country a further 30% will be due prior to export of the vehicle and the balance on delivery. If you choose to pay less than 100% prior to export a 3% service fee will be charged. Duty free vehicles or special order vehicles are normally subject to a 100% payment prior to export.
If we fail to supply the vehicle to you because of failure on our part to carry out our obligations under our contract with you, your deposit will be refunded. Otherwise deposits are non refundable.
Delivery
If we are able to we will provide an estimated delivery date in the Buyers Order. This date will be an realistic estimate (Based upon information supplied from the Manufacturer/Supplier and logistics services at the time we process your order) of when you can expect your vehicle to be delivered. The estimated delivery date is approximate only and we would not usually expect it to be longer than 8 weeks from the date of contract. While we will do our best to deliver the vehicle within the estimated time frame, we are dependent on our suppler or the manufacturer delivering the vehicle and its documentation within agreed time scales and on shipping networks for logistics. We shall not be held liable for any inconvenience or costs caused by delays in delivery or logistic services beyond our control. Should we experience a substantial delay from suppliers we may at our sole discretion cancel your order and refund your deposit or replace the order with another vehicle of similar or better specification.
Loss or Damage
We insure the vehicle with a reputable insurance company against loss or damage during transport. Should your vehicle be damaged or lost during transport we may at our sole discretion or as directed by the underwriters have the vehicle repaired by a reputable service facility or cancel your order and refund your deposit or replace the vehicle with another of similar or better specification as soon as possible.
Title to the Vehicle
The property (both legal and equitable) in the vehicle shall not unless otherwise agreed in writing pass to you until we have received in full the purchase price.
Finance and Leasing
If you choose to purchase from us using finance from a third party or through a leasing company you will be subject to further terms and conditions imposed by the finance or leasing company.
Warranty
Manufacturers warranty can be limited or may become void when a vehicle has been exported. In some markets a third party extended warranty is available. In some countries we provide customers with our AutoWard Service Card. If we have agreed to provide you the AutoWard Service Card or a third party warranty this will the specified in your Buyers Order. If not clearly stipulated in your Buyers Order such warranty services are not provided. The Buyer is solely responsible for the vehicle maintenance and any liason with service facilities regarding vehicle faults, repairs or any claims under warranty. Any claims under any extended warranty or services we may have provided shall made directly by the Buyer to Autoward.com or the applicable insurance company claims service.
First Registration
In some instances we need to pre-register a new car prior to selling or exporting the vehicle due to conditions imposed by manufacturers, dealers, rebate or fleet purchase programs that may have been used to obtain discount prices. This means that even if the vehicle is new from factory you may not appear on the vehicle title document as the first owner.
Duties and Errors
Unless we have agreed in the BuyersOrder to supply the vehicle with duty and vat paid in the destination country, you the purchaser shall be liable to pay all import duties, vat, government fees and any other costs associated with importing and registration of the vehicle.
If we have agreed to supply you the vehicle customs cleared with duty, VAT or homologation and registration in the destination country, we reserve the right to adjust the price to compensate for unforeseen cost increases due to changes in government policy or customs regulations or cost increases with homologation and local registration, currency exchange or if errors were made in our initial Buyers Order calculation.
Termination
We may terminate the contract if any of the following occur:
(i) You are unable or do not accept delivery of the vehicle at the destination port or delivery location within five working days of the delivery date contained in our notice to you of arrival and delivery.
(ii) You fail to ensure that a new delivery date is agreed or that the vehicle is collected from our delivery point within seven days of the date that we notify you that the vehicle is available for delivery.
(iii) You fail to pay the purchase price and any other sums due under the contract in full in accordance with these terms and conditions.
(iv) We reasonably believe that the contract has been formed upon the basis of a genuine typing error (due to an administrative mistake) on our website in relation to any term of the contract (including but not limited to the vehicle price) and the error is drawn to your attention.
(v) You commit a breach of any of the terms and conditions.
In the circumstances where the breaches are capable of remedy, you must do so within seven days of receiving notice from us stating such, and inform us of such remedy immediately, in which case we may not exercise our right to terminate.
In circumstances when you have not accepted and taken delivery of the vehicle within five days of the notified delivery date, w may need to arrange for the vehicle to be stored by either ourselves or a third party. In such circumstances, you will be liable for the reasonable costs of such storage and any additional transportation until the vehicle is delivered to you or the contract is terminated.
Should the contract be terminated because you do not accept delivery of the vehicle in a timely manner, we will give you a further seven days notice to remedy such breach or come to an agreement with us on a new delivery date. If you do not respond or remedy the breach we may sell the vehicle to a third party at discounted price or by online auction. We will refund you from the net proceeds generated from such discount sale after deduction of the discount granted, a 10% restocking fee, 20% remarketing costs and any additional out of pocket expenses incurred.

Online Quote and Vehicle Information
The display of vehicles on the website and/or any quotation given by us to you on the website in respect of any Car shall not constitute an offer by us to sell or supply any Car and prior to the signature by you of the BuyersOrder we reserve the absolute discretion to refuse to accept any Order from you, or to refuse to sell or supply any Car to you, without the need to provide any reason therefore.
Privacy
Personal and financial information will be treated confidentially and will not be passed on to third parties, except to the extent this is necessary in order to complete a sale transaction. Islandus.com will only use your information for such internal purposes except when required by legislation, government authorities or the courts.
Changes
Islandus.com may wish to change these Terms and Conditions at any time and without notice to you. By using the website following any changes to the terms, you agree to be bound by those changes.
Limitation of liability
We will not be liable to you for any losses that were not reasonably foreseeable to both parties when the contract was formed, losses that were not caused by any breach of these terms and conditions on the part of us, business losses (including but not limited to loss of profit, business opportunity or goodwill).
Statutory rights
Nothing in these terms shall affect your statutory rights. If you have any doubts as to your statutory rights then you should contact your Local Citizens Advise Bureau.
Jurisdiction
These Terms and Conditions of use shall be constructed and interpreted in accordance with the laws of a country mutually agreed in the Purchase Agreement. Otherwise Icelandic relevant laws will apply. The same applies to a jurisdiction. If not otherwise written in the Purchase Agreement the jurisdiction will be the Reykjavik District Court, in relation to any disputes, claims or other matters arising therefrom.
